Walter Hamberg, III has three decades of experience as a litigator in state and federal courts at both the trial and appellate level. He focuses his practice in the area of fiduciary litigation, which includes estate and trust disputes, fiduciary accountings, will contests, fraudulent transfers of property, as well as contested guardianships and conservatorships.

    We represent individuals and entities in Estate and Trust disputes, including heirs, beneficiaries, personal representatives and trustees.

  • Breach of Fiduciary Duty Claims in Estates and Trusts

    The law in Georgia sets a high standard of conduct for executors of wills, administrators of estates, trustees of trusts and guardians or conservators.

  • Fiduciary Accountings

    The law requires any fiduciary, whether executor, administrator, trustee or conservator, to maintain accurate and complete records of receipts and disbursements, and transactions performed in their fiduciary capacity.

  • Fraud, Undue Influence and Lack of Capacity Claims in Wills and Trusts

    Disputes can arise where a testator of a Will or grantor of a Trust make suspicious changes to their testamentary plans or instructions for post death asset management.

    Georgia Law provides for guardianships and conservators for minors as well as for incapacitated adults.

Walter also has a long commitment to public service. He has the honor of serving as a Trustee of the Fulton County Law Library Board of Trustees. As part of his public service he has also served as a board member on the Subcommittee for the development of Fulton County’s new Judicial Resource Center, the Poverty Affidavit Subcommittee and the Grants Subcommittee. He is a volunteer for the Georgia Volunteer Lawyer’s for the Arts, as well as the Probate Information Centers in both Fulton and DeKalb County. He also serves as an arbitrator for the Georgia State Bar Fee Arbitration program. Active in the Atlanta Bar Association, he is a member of the Estate Planning and Probate Section, the Litigation Section and the Elder Law Section.
